First, can an 11-day-old sample provide a conclusive rape result? Second, why were the video recordings of the victim’s testimony that she had fought being raped not taken into account?

    What was the reason for rushing to cremate her remains in the middle of the night and violently excluding her family members? Would the authorities have done so had the victim not been a poor Dalit girl? Did the accused get the benefit of being dominant-caste men?
    The issue of whether the victim’s stigmatised family, which has been subsisting off the compensation (Rs 25 lakh) it received, has what it takes to fight for justice, is also pertinent. 
    Tragically, the happenings surrounding this case only serve to highlight the painful reality that our society continues to be bound by an oppressive caste system, in which the dominant castes continue to subjugate marginalised groups.

    The observation that proving wrongs committed against helpless victims is difficult despite circumstantial evidence is telling since it encourages the continuation of such crimes. The brutal manner in which the Hathras victim was assaultedu2014her bones were broken, her tongue was cut off, and her family members discovered her writhing in agony in the fieldsu2014sparked widespread outrage and was reminiscent of the 2012 Nirbhaya case, which had also united the nation over violent crimes against women and resulted in the tightening of the law against heinous criminals. It appears that the family of this wronged daughter must wait longer for justice.
