The bench, composed of Justices DY Chandrachud and MR Shah, said that Ayurveda practitioners cannot be compared to allopathic doctors and therefore, cannot be entitled to the same pay. The court further emphasized that the practice of Ayurveda is a separate and distinct system of medicine, and the qualifications required to practice it are also different.
The court stated that Ayurveda practitioners have their own regulatory body, the Central Council of Indian Medicine (CCIM), which sets the standards for education and practice. The CCIM has also prescribed a separate syllabus for Ayurveda courses, which is different from that of MBBS courses.
The bench also noted that the salaries of Ayurveda practitioners are regulated by the state governments, and they are entitled to the pay scales prescribed by the state government for their respective posts. The court further observed that the government has the discretion to fix different pay scales for different categories of employees based on the nature of their work and qualifications.
The decision has been welcomed by the medical fraternity, who have been demanding a clear distinction between Ayurveda and allopathy. They have argued that the practice of Ayurveda should not be equated with modern medicine, as it is based on a different philosophy and approach to health.
The ruling has also been hailed by the CCIM, which has been working towards promoting the practice of Ayurveda in the country. The council has welcomed the court’s decision, stating that it will help in maintaining the integrity of the Ayurvedic system of medicine and promote its growth in the country.
Overall, the Supreme Court’s decision is a significant step towards recognizing the distinctiveness of Ayurveda as a separate system of medicine. It is hoped that the ruling will help in promoting the practice of Ayurveda in the country and ensure that it is given due recognition and respect.
