Before evaluating the longer-term effects of a comment made by the Chief Justice of India, D.Y. Chandrachud, during the proceedings last week, the nation will have to wait for the ultimate Supreme Court judgement on a slew of petitions seeking statutory recognition of same-sex marriages.

    The CJI raised many eyebrows when she said, There is no absolute concept of man or an absolute concept of a woman at all, in response to a point made by the government counsel. It doesn’t matter what your genitalia look like. It’s far more intricate… Therefore, even though the Special Marriages Act refers to a man and a woman, this is not an absolute.
    We are already observing the convergence of these two trends in the Supreme Court’s case involving same-sex marriage. The idea of same-sex marriage puts into question the entire institution of marriage, which has existed since the beginning of written history and transcends all religions. 
    Aspects of marriage and its dissolution have changed in the past, but the idea that it entails the union of a man and a woman has never been contested. Marriage is being tried to be changed into an exclusively happy framework from defining the framework for procreation. The ensuing effects will undoubtedly have a significant impact on the family, society, and the country. In essence, the world is being asked to be flipped inside out.

    The Supreme Court has been asked to rule on the legalisation of same-sex unions, and this has happened without even the slightest public discussion. Most of India is utterly unaware of the reasons why the institution of marriage is being sought to be fundamentally rethought, despite some cursory coverage of the subject in the national media. The Supreme Court doesn’t seem to want to take the case to Parliament or to broaden the investigation by involving social or religious organisations.
    It appears that India is being forced-fed a radical interpretation of the new enlightenment.
