Even if the US Secretary of State is empowered to make the ultimate decision about the extradition, Rana has the option of filing an appeal before the Circuit Court. India’s attempts to extradite Rana to the US for prosecution have been blocked because the US authorities have not been able to compile a solid case against Rana over the years.
Even while a US jury convicted Rana guilty of giving material support to the LeT, a Pakistan-based terrorist organisation, in June 2011, the jury had exonerated him of participating in the Mumbai attacks.
Later on in the year, the National Investigation Agency of India issued a chargesheet charging Rana, his boyhood friend David Coleman Headley, LeT founder Hafiz Saeed, and seven other people of planning the 26/11 carnage.
Due to Headley’s plea agreement with the US Department of Justice, India has already forfeited the possibility to obtain his extradition. He admitted organising and carrying out the Mumbai attacks, but under a questionable agreement, he was spared the death penalty and was not extradited to any nation.

Despite being informed of Headley’s intimate ties to Pakistan’s ISI espionage service, it appears that the US did nothing to take precautions. Despite frequently referring to India as a crucial ally in the fight against terrorism, Washington hasn’t gone far enough to win over New Delhi. India has to put pressure on the US right away so that the Rana matter may be resolved logically.
