Competition Act Applies To Public Sector Undertaking Like Coal India, Rules SC

The apex court’s ruling came in response to a petition filed by Coal India Limited, challenging the jurisdiction of the Competition Commission of India (CCI) to investigate allegations of anti-competitive conduct against the PSU. Coal India argued that being a PSU, it fell outside the purview of the Competition Act, which primarily applies to private enterprises.

Rejecting Coal India’s contentions, the Supreme Court upheld the authority of the CCI to scrutinize the conduct of PSUs and ensure fair competition in the market. The court stated that the Competition Act was enacted with the objective of promoting competition and preventing anti-competitive practices across all sectors, irrespective of their ownership or public or private character.
