The state government has been ordered by the court to submit an affidavit detailing how many structures in Nuh and Gurugram have been demolished over the last two weeks and if any prior notice was given.

    After a religious procession was attacked by a crowd on July 31, communal fighting broke out in Nuh; Gurugram soon followed. The authorities have razed several ‘illegally built’ buildings, including shanties and stores, in recent days. Officials assert that letters were sent to the owners of some of these homes or businesses, which they believe belonged to rioters. 
    However, the timing of the demolition effort and the overall exercise’s apparent selectivity convey the appearance that members of a minority population are receiving immediate retribution without being fully investigated for their claimed involvement in the violence.

    In various states in recent years, notably BJP-ruled Uttar Pradesh and Madhya Pradesh, bulldozer justice has established itself as the standard. An advisor to the chief minister of Uttar Pradesh tweeted a picture of a bulldozer tearing down a structure in June of last year along with the caution, Rioters, remember, every Friday is followed by a Saturday. 
    The delivery of justice is being threatened by this disdain for the rule of law and vengeful use of the governmental apparatus. Action against encroachers should always follow the established procedure; political or communal factors should not be taken into account. The High Court correctly recognised the authorities’ blatant overreach.
