The court stated that every move of the ED was supposed to be transparent, above board, and conforming to pristine standards of fair play in action when it ordered the release of the directors of a Gurugram-based real estate business in a money laundering case.

    The court’s findings come in the wake of complaints from the AAP and other opposition parties that the BJP-led Centre is abusing the ED to settle political scores. Party members have demonstrated against Sanjay Singh’s detention in Delhi and other cities across the nation. 
    Sanjay Singh is the second prominent AAP politician to be apprehended by the ED this year (after Manish Sisodia). In the months leading up to the General Election in 2024, opposition leaders are concerned that additional arrests of this nature will occur.

    According to the ED, AAP spent Rs 100 crore on its campaign for the Goa Assembly election last year, money it got as bribes from various stakeholders.The political party believed to be the primary beneficiary of an alleged fraud, however, has not been named as a defendant in the money laundering case relating to the now-scrapped excise policy, the supreme court has asked the directorate to explain.
    The ED would be well to take careful note of the court’s requirements given its repeated accusations of overreach and overzealousness. Any attempt to evade the due process during an investigation would damage the agency’s reputation. Regardless of a person’s political inclinations, no corrupt individual should be spared, but at the same time, no innocent person should be blamed.
