The Bills propose 32 per cent reservation for Scheduled Tribes, 27 per cent for Other 1 Backward Classes, 13 per cent for schedule castes and 4 percent for EWS in public employment and admissions in educational institutions.
The bills are still pending with the governor, Anusuiya Uikey, who has asked for information on the rationale behind the state government’s decision to go over and beyond the legal limit of 50 percent for reservations.
The ten answers requested by Uikey include information on any quantitative data on SC/ST communities that the government may have gathered before submitting the Bill; any study or exceptional circumstance requiring the state government to increase reservations above the 50% threshold; information on how SC/ST are denied opportunities for social, economic, and educational advancement in the state; and any committee report in support of the Bills. We have sent a reply to the Governor even though such an arrangement is not there in the Constitution. She should have taken replies from the depart- ments concerned. But the reply has been sent. Now she should sign (on the Bill), said the Chief Minister Bhupesh Baghel. When the Chhattisgarh High Court overturned the Raman Singh-led state government’s 2012 order to increase the quota to 58 percent in government jobs and admissions to educational institutions, stating that reservation above the 50 percent ceiling was unconstitutional, the issue of reservation erupted. After reading the blog please write your opinion in the comments.
