A group of 55 opposition MPs from the Rajya Sabha has filed an impeachment motion against Justice Shekhar Kumar Yadav of the Allahabad High Court. The motion, led by independent MP Kapil Sibal, accuses Justice Yadav of delivering a hate speech that incited communal disharmony, citing remarks he made at a Vishva Hindu Parishad (VHP) event on December 8. The MPs argue that his statements breached judicial ethics and impartiality, violating Article 124(4) of the Constitution and the Restatement of Values of Judicial Life

In his speech, Justice Yadav allegedly targeted minorities and discussed political issues like the Uniform Civil Code, stating that the country would align with the “wishes of the majority.” Such remarks have drawn sharp criticism for undermining the judiciary’s integrity

Impeachment requires at least 50 MPs in the Rajya Sabha or 100 in the Lok Sabha to move a motion, followed by approval through a two-thirds majority vote in Parliament. Although seven impeachment motions have been initiated in the past, none have led to the removal of a judge, with some resigning during the process.
