Despite the collegium’s frequent reminders, the regulation has recently been regularly broken, with the Center delaying appointments. The repetition of the names may be a strong statement in light of this context, but it is not exceptional. What is noteworthy, though, is the collegium’s articulation of the premises upon which it bases its decision. The Centre took issue with Saurabh Kirpal, the new member of the Delhi High Court, having a foreign national as a homosexual partner.
    The Supreme Court’s resolution allegedly noted that everyone was allowed to keep his dignity and individuality depending on his sexual orientation, zeroing in on the Centre’s displeasure with the candidate’s sexual orientation, which was pretty evident from sections of its letter. Additionally, the Intelligence Bureau’s concerns about R.J. Sathyan’s posting of two articles on social mediau2014one critical of the prime minister and the other about a student who committed suicide and blamed political betrayalu2014were reportedly disregarded by the court when it repeated his name as a candidate for the Madras High Court.

    The court mentioned the candidates’ integrity and appropriateness in both instances, pointing out that the IB had not discovered any indications of Mr. Sathyan’s political leanings. That is, criticism of the prime minister was no reason to refuse him his due place, just as sexual orientation was not in Mr Kirpalu2019s case either.The court’s assertions of constitutional principles are essential to a pluralistic and inclusive democracy. Though the Supreme Court’s stance cannot be overstated, the Centre’s issue with an openly gay judge highlighted the need for clarification not only between the executive and judiciary but also between the government and the people (should the people lead the government with their biases? ),as between the people and the courts. Trust born of a shared vision and perception of rights would be ideal in the last situation.
