The court ordered the prosecution of returning officer (RO) Anil Masih, a BJP councillor nominated, for making a false statement before the Bench claiming to have invalidated eight voting papers because they had been “defaced,” citing illegality in the results published by the RO. 

    The coalition accused the RO of tampering with the ballots because the BJP had won the poll due to the eight AAP-Congress votes not being counted at that time.Chief Justice DY Chandrachud’s bench argued that in this kind of case, the highest court had an obligation to make sure that deceitful tactics could not undermine the democratic process.

    By its admirable intervention, the court has righted a serious wrong. The BJP is extremely embarrassed by the event, since its plan to orchestrate a win has been derailed. Finally, the disparities among its members have given the INDIA bloc cause for celebration.

    The success of the AAP-Congress candidate has highlighted how urgently the Opposition needs to organise itself in the lead-up to the Lok Sabha elections. The decision serves as a clear reminder to all parties involved—political parties, voters, and poll workers at all levels—that the integrity and impartiality of elections must always be upheld. It is a stain on our democracy and should not be accepted when attempts are made to undermine the mandate. The Chandigarh case should act as a disincentive to using unethical tactics in elections.
